Welcome to Eden Smart Living Pte. Ltd.’s Website (https://edensmartliving.com). In the interpretation of this Terms and Conditions, the following expressions bear the literal meanings, namely: (“Website”, “Products”, “Services”, “Sales Order”, “Invoice” and “Customer”).
1.1 Access to this Website is permitted on a temporary basis, and all data on this Website is published “As is” and is correct at the time of publishing. Eden Smart Living reserves the right to withdraw, amend data or restrict access to parts of the Website at our own discretion and without prior notice. Eden Smart Living will not be held liable if, for any reason, this Website is unavailable at any time or for any period.
1.2 You are prohibited from misusing this Website. You will not: (a) commit or encourage a criminal offence; (b) transmit or distribute any material which is malicious, technologically harmful, in breach of confidence or in any way offensive or obscene; hack into any aspect of the Website; (c) corrupt data; cause annoyance to other users; (d) infringe upon any other person’s proprietary rights; (e) or attempt to affect the performance or functionality of any computer facilities of or accessed through this Website. Any breach of this provision constitutes a criminal offence under the Computer Misuse Act (Chapter 50A). We will not hesitate to report any such breach to the relevant law enforcement authorities and disclose your identity to them.
1.4 Eden Smart Living shall be excluded from any liabilities of any loss, damage or misadventure caused directly or indirectly in connection with: (a) any access, use and/or inability to use the Website; (b) reliance on any data or information made available through the Website; (c) any system, server or connection failure, error, omission, interruption, delay in transmission, computer virus or other malicious, destructive or corrupting code, agent program or macros; and (d) any use of or access to any other Linked Sites to the Website.
1.5 If you are below 18 years old, you must obtain consent from your parent(s) or legal guardian(s), their acceptance of these Terms and Conditions and their agreement to take responsibility for: (a) your actions; (b) any charges associated with your use of any of the Services or purchase of Products; (c) your acceptance and compliance with these Terms and Conditions. If you do not have consent from your parent(s) or legal guardian(s), you must stop using/accessing this Website.
1.6 You may access and use the website as a guest or as a member. To become a member of the website, you must provide your name, telephone number, a valid email address and nominate a password. If you do not provide accurate and complete details we may not be able to activate your membership or supply goods or services to you.
2. Intellectual property
2.1 The Intellectual Property in and to the Website and the Materials are owned, licensed to or controlled by us, our licensors or our service providers. We reserve the right to enforce its Intellectual Property to the fullest extent of the law.
2.2 No part or parts of the Website, or any Materials may be reproduced, reverse engineered, decompiled, disassembled, separated, altered, distributed, republished, displayed, broadcast, hyperlinked, mirrored, framed, transferred or transmitted in any manner or by any means or stored in an information retrieval system or installed on any servers, system or equipment without our prior written permission or that of the relevant copyright owners. Subject to Clause 2.3, permission will only be granted to you to download, print or use the Materials for personal and non-commercial uses, provided that you do not modify the Materials and that we or the relevant copyright owners retain all copyright and other proprietary notices contained in the Materials.
3. Limitation of responsibility and liability
3.1 Eden Smart Living shall be excluded from any liabilities of any defect arising from: (a) unsuitable or improper use; (b) defective installation or commissioning by the Customer or third parties; (c) foreseeable wear and tear; (d) willful damage; (e) negligence; (f) abnormal working conditions; (g) unsuitable operating materials and replacement materials; and (h) poor foundation work or chemical/electric influences.
3.2 Eden Smart Living shall be excluded from any liabilities of injuries, expenses, damages or consequential loss, arising from: (a) unsuitable or improper use; (b) negligence; and (c) any post-modification methods mentioned in clause 3.1
4. Conditions of sale (ONLINE)
4.1 All online Sales Order are final and strictly non-refundable. You are responsible in ensuring the accuracy of your Sales Order placed via the Website.
4.2 Eden Smart Living endeavors to provide an accurate description of the Products, however, these may be subjected to changes in future. In the event that the Product you receive is of a fundamentally different nature from the Product as described on the Website and which you have ordered, Clause 9 of these Terms and Conditions shall apply.
4.3 Sales Orders are irrevocable and unconditional: All Sales Orders will be deemed to be irrevocable and unconditional upon transmission through the Website and Eden Smart Living shall be entitled (but not obliged) to process such Sales Order without your further consent and without any further reference or notice to you.
4.4 All Sales Order shall be subjected to Eden Smart Living’s acceptance in its sole discretion and unless you receive a notice from Eden Smart Living accepting your Sales Order, Eden Smart Living shall not be party to any legally binding agreements or promises.
4.5 In any event when we receive your Sales Order and we discover an error in our pricing online, we will inform you as soon as possible with the option of cancelling or re-confirming your order at the correct price. If for any reason we are unable to contact you using the contact details you have provided we will treat the order as cancelled and notify you by email. Any cancelled orders will be refunded within 14 days of notice of the cancellation.
4.6 The price of the Products payable shall be the Listing Price at the time at which the Sales Order placed through the Website by the Customer. All payments shall be in Singapore Dollars and payment shall be made in the manner specified by the Website.
4.7 Not all promotions that are offered by Eden Smart Living online will be available in-store, and vice versa. We reserve the right to adjust prices, products and special offers at our discretion.
4.8 All products are subjected to availability and so we may not be able to supply your order in unforeseen circumstances, we will notify you as soon as possible, and update accordingly. In any case, we may have to stop selling this Product.
5. Conditions of sale (OFFLINE)
5.1 All offline sales are final and strictly non-refundable.
5.2 Keep-In-View Products are to be confirmed at least 2-6 weeks prior to delivery, depending on the Product. Should customer fail to take delivery of the Keep-In-View Product within 6 weeks from the date of the Order Confirmation, any deposit, advance payment and/or pre-payment, clause 5.3 will take effect.
5.3 If the customer should on his/her part fail to observe or comply with any of the terms herein contained, all deposit, advance payment and/or pre-payment for or in respect of the Product(s) shall be forfeited to Eden Smart Living and Eden Smart Living shall be at liberty to sell or dispose of the Product(s). Any deficiency in price that may result in and all expenses attending a resale or attempted resale in respect thereof shall be made good and paid by the Customer and recoverable by Eden Smart Living.
5.4 All Product(s) shall be inspected immediately prior to the Invoice being issued and the issuance of the Invoice to the Customer shall be deemed by Eden Smart Living that the customer has inspected the Product(s) and has determined that the Product(s) are undamaged and in a satisfactory and acceptable condition.
5.5 The provisions of clause 5.4 shall not apply to any Product(s) designated by Eden Smart Living as being showroom Product(s) or Product(s) that are on ‘special offer’ or ‘sale’ or any other indications that the Product(s) are being sold at a price that is less than the usual price of Eden Smart Living’s Product(s). However, Eden Smart Living will still ensure that all Products has been checked thoroughly before sending out to customers.
5.6 Property of the Product(s) remains with Eden Smart Living until receipt of full payment for the Product(s) in which ever payment methods.
5.7 The contract price for the Product(s) shall be that stated in the Invoice. Any Product(s) and Services Tax (if applicable) shall be borne by the Customer. All payments shall be in Singapore Dollars and payment shall be made in the manner specified in the Invoice.
6.1 You may make payment for the Product using any of the payment methods prescribed by Eden Smart Living at the respective showrooms.
6.2 By making payment in our website, you agree that you are subject to the applicable user agreement of your payment method. You may not claim against Eden Smart Living for any failure, disruption or error in connection with your chosen payment method. Eden Smart Living reserves the right to modify or discontinue, temporarily or permanently, any payment method without notice or reason.
6.3 Our special association with DBS Asia Pay gives you 0% interest finance options, allowing you to spread your payments over 12 months. The instalment plan is available for DBS VISA/MasterCard & POSB MasterCard Credit cardholders only. This is only eligible for orders above $500, with a limit of $6000 per transaction.
7. Customization of Product
7.1 Changes to ready-made items are subjected to 10-50% of total sales value and must be done before confirmation of delivery date. Changes to customized items are subjected to approval.
8.1 We have our in-house delivery team to deliver your Product(s) in excellent condition, and other carefully selected delivery service providers especially for Door-step Deliveries. Please note that furniture items are only delivered within Singapore and our Standard Delivery timings are:
Monday to Saturday with 3 time slots; 9am – 12pm / 12pm – 3pm / 3pm – 6pm.
8.2 Delivery charges are usually free, unless certain situation arises. Refer to clause 8.3.4 and 12.2.
8.3 For bulky furniture, delivery will be scheduled in advance.
8.3.1 We will deliver your order into your home and place them in an area of your choice. We will also assemble the furniture (if applicable), and remove all packaging materials from your premise, as well as making the area as clean as possible.
8.3.2 Please ensure that there is someone to receive the delivery on the pre-agreed date and time, and that the delivery path and premise are free of obstacles and blockage.
8.3.3 For any changes/enquiries regarding your confirmed delivery schedule pertaining to this order, kindly contact us at least 3 days in advance so that we can make the necessary arrangements, else there will be a $80 charge for any last minute changes.
8.3.4 Additional Delivery fee for non-lift accessible floors: Do take note that there is a charge of $10 per item per non-lift accessible floor which must be collected by our delivery team before the completion of the delivery. This fee will also be applicable to stairs within landed properties or HDB maisonette. This applies to our disposal services as well. This has to be informed to us during your purchase.
8.3.5. Delivery will only proceed if the delivery team deems it suitable to go ahead in a non-hazardous manner. If the lifting process is deemed hazardous, (i.e. items prone to damage on narrow stairway, obstruction of passageway), and deemed unfeasible based on our assessment; we reserve the right to cancel the delivery, and will work out an alternative. This applies for our disposal services as well.
8.4 For smaller furniture items, delivery will take place as soon as your order is ready for delivery, and our Customer Service will contact you to arrange a delivery date.
8.4.1 We will deliver to the door-step of your premise, to you or an authorized personnel authorized to receive the order on your behalf.
8.4.2 If you are unable to receive your order during our first delivery attempt, please do not worry! We will let you know the delivery failed, and you may reschedule a date and time which is convenient for you. However, it would be best if you can inform our customer service personnel during the scheduled call, or before the day of delivery, as otherwise, second delivery charge may apply.
8.4.3 In the event that your order cannot be delivered due to you not being contactable to schedule a delivery, your order will be held for a maximum of 30 Days from the date of first attempted failed delivery. If there is no response within this month, your order will be cancelled without refunds.
8.5 The delivery date & timing is an estimate on when the customer would like to receive their products & Eden Smart Living will try its best to adhere to it. However should there be any unforeseen circumstances Eden Smart Living reserves the right to schedule the delivery date and timing even with the customer’s preferred time for delivery slots. If the Customer is not at the delivery address at the mutually agreed time, Eden Smart Living reserves the rights to incur additional charges for extra delivery services.
8.6 Eden Smart Living shall not be liable or be deemed to breach the Conditions of Sale if the delivery is delayed due to unforeseen circumstances that are beyond Eden Smart Living control.
8.7 Eden Smart Living is able to hold your order for a maximum of 30 days, where within that time, a delivery date has to be confirmed by the customer.
9. Disposal Service
9.1 Disposing or rearrangement of existing furniture upon delivery is not provided unless stated by the customer. If in that case, let our efficient delivery team help you with the disposal of your unwanted furniture, on the same day as your furniture delivery! Additional charges apply, depending on your item, from $30-120 per item.
9.2 Disposal service is not applicable for the following: (a) Dismounting from walls or ceilings; (b) Not informing us beforehand.
9.3 Prior to disposal of used furniture, customer have the responsibility to ensure sufficient space is cleared for our delivery team and that all loose decorative items are to be removed before-hand from the item that is to be disposed.
9.4 As we need to cater for space on our delivery trucks for other deliveries and disposals, we seek your understanding that we will not be able to accept additional disposal requests on the spot.
10. Condition of Product
10.1 Customer shall inspect the Product(s) upon receipt of delivery. Should there be any visual/ superficial defects, the Customer must notify Eden Smart Living within 48 hours after the delivery. Eden Smart Living reserves the rights not to address any complaints on superficial defects after the stipulated time frame.
11.1 All Product(s) (except display sets) are sold & thoroughly checked through to ensure good condition before delivery. Products are covered with warranty (terms and conditions apply) from the date of delivery, against manufacturing defect. Our warranty do not cover the following: (a) unsuitable or improper use; (b) defective installation or commissioning by the Customer or third parties; (c) foreseeable wear and tear; (d) willful damage; (e) negligence; (f) abnormal working conditions; (g) unsuitable operating materials and replacement materials; and (h) poor foundation work or chemical/electric influences.
11.2 We are confident of our advanced hydraulic technology. However, should our Customers need assurance, our Products are covered with lifetime warranty which warrants to a 1-to-1 exchange. The Product(s) applicable are: (a) Desk Bed’s Gas Spring; (b) Wardrobe with Study Desk’s Roller.
11.3 The structure of our Products are covered with 3 years warranty. Once contacted, our engineers will head down to assess the condition of the Product and provide onsite maintenance. The following structural defects are applicable for this service: (a) Frames collapse under normal usage; (b) Spring collapse under normal usage; (c) Hinge drop out under normal usage. In any event that Customer is looking at a refund or exchange, clause
12.2 will take effect.
11.4 Customer shall bear all repair costs (if there are any) that are carried out for defects that do not qualify under the warranty scheme, or for those beyond the warranty period.
12. Exchange and Cancellation Policy
12.1 In the event that Customer requests for an exchange before delivery has been fulfilled OR is in the midst, we’ll gladly process it with no additional costs to you. Note that exchanges are only available for items of the same price or less. The balance amount will be refunded to the same method of payment as the original payment. If you’d like to exchange for an item of a higher price, we will cancel the original item for you and you will have to place a separate order. Please call us to facilitate any of such arrangements. These clause does not apply to custom made items.
12.2 In the event that Customer requests for an exchange after delivery has been fulfilled, a 10-30% restocking fee or a minimum of SGD$90 will apply on those Product(s) returned by the Customer, whichever is higher. However, Eden Smart Living reserves the right to refuse the Product(s) if they are not returned in good and working conditions. Should the Customer require Eden Smart Living to collect the Product(s) on their behalf, second delivery charges as determined by Eden Smart Living will apply.
12.3 The Customer cannot choose to cancel the Sales Order unless the Customer has indemnified Eden Smart Living with a 30% cancellation fee, or in full losses (including loss of profit), charges and expenses incurred by Eden Smart Living as a result of the cancellation, whichever is higher.
12.4 In the event of Products differing from the description or is unusable, do refer to Buyer Protection Policy, clause 3.2.
13.1 In the event of any events beyond our control, such as act of foreign enemy hostilities (unofficial declaration included), riots and strikes, breakdown of assets, Eden Smart Living shall be relieved of liabilities incurred under any Contract.
13.2 The laws of the Singapore shall govern and apply to the interpretation of the Conditions and to any Contract.
13.3 In the event that any of these terms and conditions are held to be a violation of any applicable law, such term shall be deemed to be deleted from these terms and conditions and the relevant Contract shall remain in full force and effect as if such provisions had not originally been contained herein. Eden Smart Living and the Customer shall negotiate in good faith to agree on the terms of a mutually acceptable and satisfactory alternative provision in place of the provision deleted pursuant thereto.
